A team of Haynes and Boone, LLP attorneys won a victory in the Houston First Court of Appeals on Nov. 21, 2023, resulting in a complete affirmance for Lindale Pipeline, LLC of its $24 million judgment against Equinor Energy.
Both parties brought breach-of-contract claims against one another based on a contract regarding a freshwater pipeline in North Dakota. After a seven-day jury trial, the trial court entered a $24 million judgment on the jury verdict in Lindale Pipeline’s favor.
The Haynes Boone team led the post-judgment briefing and appeal after offering significant assistance at trial. The primary issues on appeal were whether the pipeline agreement provided Lindale Pipeline the exclusive right to provide freshwater to certain Equinor wells and whether sufficient evidence supported the damages awarded. The Court of Appeals ruled for Haynes Boone’s client on all issues.
