A team of Haynes and Boone, LLP labor and employment lawyers has obtained a significant 5th U.S. Circuit Court of Appeals victory for client ISS Facility Services in an appeal of a National Labor Relations Board (NLRB) unfair labor practice charge.
San Antonio Partner Laura O'Donnell led the Haynes and Boone team, which included Dallas Associates rel="noopener noreferrer" Alex Stevens and Andrew Guthrie.
The appeal stemmed from the NLRB’s finding that the client's mandatory arbitration agreement constituted an unfair labor practice because it contained a class action waiver and, according to the NLRB, could be read to prevent employees from understanding that they could file NLRB charges.
The 5th Circuit summarily reversed and refused to enforce the NLRB’s order entirely, resulting in a complete win for ISS.
