Haynes Boone Partner Vincent Shier was drawn to this decision falling in a line of cases where the Federal Circuit overturned large verdicts.

"What it underscores is that the lack of uniformity and clarity — and the complexity of dealing with — damages awards and reaching some kind of model that can be widely accepted and implemented," Shier said. "It often seems like there's a complete lack of certainty or reasonable expectation that your award will hold up."

The case is Roche Diagnostics Corp. v. Meso Scale Diagnostics LLC, case numbers 21-1609 and 21-1633, in the U.S. Court of Appeals for the Federal Circuit.
