The Texas Supreme Court is poised to decide a number of cases of interest to the energy industry in 2016, including cases involving the calculation of royalty and overriding royalty interests, the treatment of production payments, and the scope of surface owner rights.
In one case, the court is considering whether to modify an earlier opinion in light of a pending motion for rehearing that has garnered significant amicus support. The court has granted review and heard argument in two additional cases, with opinions expected soon. In two other cases, the court has ordered full briefing and may soon decide whether to add them to its docket. These cases are summarized below.
