Blikshteyn in Managing IP: The Importance of Client Consent in Using AI

Firms are beginning to use AI tools for patent drafting, according to Haynes Boone Partner Dina Blikshteyn. She spoke with Managing IP about the risks of using AI for client work and discussed the importance of client consent in using these tools.

Blikshteyn told Managing IP that a lot of firms are starting to use AI tools for patent drafting.

“But there might be confidentiality issues down the line when it comes to what happens to the patent application data and whether it is, in fact, confidential or can be used by a third party or large language model for training.” 

She adds that AI vendors are currently saying that everything is secure. But there’s still some risk, she argues.

“Unfortunately, we won’t be able to tell until further down the line.” 

For the time being, she adds, firms should be getting clients’ consent to use these tools and making sure they understand any risks.
