Blikshteyn in ManagingIP: How IP Counsel are Dealing with Massive Upswing in AI Work

Haynes Boone Partner Dina Blikshteyn was quoted in a ManagingIP article as counsel claim that AI has been a bigger part of their transactional practices, though they warn that it is crucial to weigh the risks of the technology in an uncertain landscape.

"Push comes to shove; there is no certainty right now," Blikshteyn told ManagingIP. “During an acquisition, it's an attorney's job to counsel clients and see what the exposure [risk of a lawsuit] is," she says.

"The biggest challenge is that you don't know what you don't know. This is a new technology and fairly unsettled area of law. Until new legislation is passed, everyone is in a sort of flux."

Blikshteyn also pointed out that people didn't used to know that generative AI tools could hallucinate, meaning that they can create false information.

"Right now, clients are more familiar with the fact that the models can hallucinate, and they ask if there are ways to reduce it," she says.
