Heijkoop in Ignites: Industry Wants More Fund Pricing Flexibility; the SEC Isn’t Ready

Haynes and Boone, LLP Partner Arie Heijkoop was quoted in an Ignites article on the desire within the fund industry to implement flexible pricing structures for mutual funds, similar to those used by collective investment trusts and separately managed accounts.

"If regulators ever approve different fees for the same share class, there must be adequate disclosure for it," said Arie Heijkoop, partner at Haynes Boone.

“If a fund is going to have these arrangements, it’s very important that a shareholder can understand if they’re eligible to invest in these multiple share classes and what’s the bottom-line difference for [them],” he said.

When there are multiple share classes within the same fund, the main difference in the fees and expenses “is with respect to the shareholder service or distribution fee,” Heijkoop said.
