Howley Mills in The National Law Journal: EPAs Forever Chemicals Plan Lacks Specifics

Haynes Boone Partner Clarissa Howley Mills spoke with The National Law Journal after the U.S. Environmental Protection Agency's recent announcement that it is examining its policy on forever chemicals left unclear whether the agency will take a deregulatory stance toward the contaminants.

If there is deregulation of forever chemicals, it will likely be to reduce the burden on “passive receivers” of pollution, such as water utilities charged with cleaning up PFAS even though they do nothing to contribute pollution, Mills told The National Law Journal.

The EPA’s announcement said it will work to make sure polluters pay and passive receivers are protected.

“I think it'll be interesting to see if industry is okay with that or wants to continue pursuing those lawsuits,” Mills said. She added there is a question of whether the EPA will have the resources to address PFAS as outlined in its statement.
