Schwarz in The American Lawyer: Haynes Boone Wins $6.5M Judgment in RedHill Biopharma Case

Following an appellate win in in front of the New York Supreme Court, Appellate Division, First Judicial Department, Haynes Boone Associate Rebecca Schwarz spoke with The American Lawyer detailing why the court affirmed a $6.5 million summary judgment in addition to interest and costs for RedHill Biopharma Ltd.

Simplicity won the day in a New York appellate court that unanimously upheld a $6.5 million judgment against a South Korean company for breach of contract.

Kukbo failed to make required payments under licensing agreements for an experimental drug to treat Covid-19, said Schwarz, who argued the case in front of the New York Supreme Court, Appellate Division, First Judicial Department.

"Simpler is better in these arguments," Schwarz said.

Haynes Boone's winning strategy for the case centered on treating a complex pharmaceutical licensing dispute as a straightforward breach of contract case, despite opposing counsel's attempts to complicate matters with multiple counterclaims, according to Schwarz.

Schwarz is a seventh-year associate. She said her mentor, Leslie Thorne, allowed her to handle oral arguments, highlighting the firm's culture of developing junior talent under senior guidance.

"Many associates never get these stand-up opportunities before they make partner, and the fact that she and the client were willing to give me the opportunity really speaks to the culture of the firm," Schwarz said.
