Haynes and Boone, LLP Partners J. Andrew Lowes, Russ Emerson and Greg Webb and Associate Clint Wilkins represent Ericsson Inc. in inter partes reviews of five University of Minnesota patents involving wireless communications technology. The cases involve novel legal issues regarding state sovereign immunity and the university’s request of the Patent Trial and Appeal Board to dismiss the inter partes reviews.
In those cases, Ericsson argues that, to the extent the university has sovereign immunity against a challenge to the asserted patents, such immunity was waived when it sued Ericsson customers AT&T, Sprint, T-Mobile and Cellco Partnership for patent infringement, Law360 reported.
