Haynes Boone second International Project Boot Camp Series presentation is titled Overturning and/or Protecting Arbitration Awards.
Although arbitration awards are generally binding and enforceable, they are not unassailable. This presentation discusses (1) how parties have successfully challenged arbitration awards rendered in both international and domestic arbitrations and (2) best practices to protect and enforce awards under the New York Convention and the Federal Arbitration Act.
We will examine:
- Grounds and procedures for protecting and challenging the enforcement of international arbitration awards under the New York Convention
- Grounds and procedures for protecting and vacating domestic arbitration awards under the Federal Arbitration Act
- Considerations to build in heightened appellate review
- Strategies for drafting arbitration clauses
