Haynes and Boone Secures $15 Million Arbitration Award

August 05, 2019

Haynes and Boone, LLP Partner Mark Trachtenberg and Associate Andrew Guthrie, along with a team from the Thomas J. Henry Law firm led by Russell Endsley, won the affirmance of a $15 million arbitration award in favor of a client injured on the job.

The client was electrocuted in 2013 while accessing an electrical box that controlled the lighting for a parking lot at his workplace.

After an arbitrator awarded the client $15.8 million in damages, the defendant appealed pursuant to an arbitration agreement between the parties that allowed for review by a second arbitrator.

Following extensive briefing, Trachtenberg argued the case in April before the appellate arbitrator, who issued an opinion July 28, 2019 rejecting the defendant’s legal challenges to the award and concluding that there was sufficient evidence to affirm the first arbitrator’s findings.

A Houston partner in Haynes and Boone’s Appellate Practice, Trachtenberg has handled numerous cases in the Texas Supreme Court, the U.S. Court of Appeals for the Fifth Circuit, and in various courts of appeals in Texas. He is a frequent writer and speaker on appellate topics, including presenting this recent, detailed overview of arbitration-related litigation at the State Bar of Texas’ 10th Annual Business Disputes seminar.

Guthrie is an associate in the Dallas office who focuses his practice on appeals and critical trial court briefing across an array of subject matters, including business disputes, products liability, intellectual property, the False Claims Act, probate and trusts, and water rights.

With one of the largest full-time appellate teams of any national law firm, Haynes and Boone’s Appellate Practice Group can match clients with appellate lawyers who offer personal experience with specific industries, procedural issues, and courts. Team members have argued appeals before the U.S. Supreme Court, the federal circuit courts of appeals, and all levels of state appellate courts, setting precedents for our clients in jurisdictions from coast to coast.
