Haynes and Boone's Outage Task Force Helps Clients Weather the Texas Storm

February 25, 2021

As the massive winter storm descended upon Texas this month, practice group leaders at Haynes and Boone, LLP quickly assembled a task force to respond to the many urgent questions from clients whose businesses have been severely impacted by the storm.

Members of the firm’s Outage Task Force work in practice areas including Energy, Power and Natural Resources; Capital Markets and Securities; Project Finance and Development; Insurance; Litigation; and Restructuring.

“The lawyers in our taskforce are steeped in the issues that businesses face as they deal with continuing fallout from the storm and the evolving regulatory landscape in Texas with implications for companies and investors that extend well beyond Texas,” said Partner Diana Liebmann, a leader of Haynes and Boone’s Power and Renewables Practice.

Liebmann has helped clients through multiple restructurings of the electric power markets in Texas and is the point person for many regulatory/ERCOT-related questions. “Because of our deep knowledge of the energy marketplace, we can provide quick and creative solutions for our clients,” she said.

Here are a few examples of the types of issues the task force is addressing:

  • Civil Investigative Demands to power providers
  • Insurance claims for business interruption losses and third-party claims
  • Contract claims against ERCOT and power companies
  • Restructuring and bankruptcy advice for power companies
  • Changes to the regulatory landscape

The task force will also periodically distribute alerts about key legal and business topics related to the winter storm. (To see an example, click here.)
