We represented a national retailer who was issued citations challenging its safety program regarding powered industrial truck equipment used in its warehouse. The citation alleged that changes were needed to revise its safety program following an accident. At trial, our firm succesfully convinced the court that the accident was the result of unforseeable factors that did not justify any changes to its effective safety programs.
