Haynes and Boone, LLP Partner Joe Lawlor was quoted in a Managing IP article on the Supreme Court seeing four Intellectual Property cases in 2023, including Jack Daniel's Properties, Inc. v. VIP Products, LLC.
Lawlor says courts will now have to look at Jack Daniel’s in all cases where the Rogers test could potentially apply.
“I think this will have a pretty broad impact even if the court didn’t address an area that it could have,” he tells Managing IP.
