Haynes and Boone served as Lead Counsel and PTAB trial team for Petitioner in Rackspace US, Inc. and Rackspace Hosting, Inc. v. PersonalWeb Technologies, LLC and Level 3 Communications, IPR2014-00057, IPR2014-00058, IPR2014-00059, IPR2014-00062 and IPR2014-00066. Represented Rackspace in IPRs challenging five (5) patents widely-asserted by non-practicing entity (NPE) against on-line storage, hosting, back-up companies and source-code repositories. Successfully instituted as to all challenged claims and prosecuted challenge through depositions and full trial briefing. NPE plaintiff dismissed district court assertion, and parties jointly terminated IPRs just prior to oral hearing.
