Haynes Boone successfully represented Unified Patents in a significant patent appeal victory before the U.S. Court of Appeals for the Federal Circuit, which affirmed a Patent Trial and Appeal Board decision invalidating the majority of challenged claims in a VideoLabs Collective patent.
In a Feb. 20 decision, the Federal Circuit upheld the PTAB’s ruling that claims of U.S. Patent No. 8,605,794 are unpatentable. The three-judge panel concluded that VideoLabs forfeited its primary-claim construction argument by raising it for the first time on appeal. The court also agreed that Unified was entitled to respond to new claim-construction arguments raised during the PTAB proceedings and found that the board’s anticipation determination was supported by substantial evidence.
