Haynes Boone has secured its fourth major victory in four weeks at the U.S. Court of Appeals for the Federal Circuit, winning a case for client Unified Patents, LLC, that invalidates a patent on video streaming technology.
The decision affirms a ruling by the Patent Trial and Appeal Board (PTAB) and helps ensure streaming technologies remain open for development.
In the case of DivX, LLC v. Unified Patents, LLC, the Federal Circuit upheld the PTAB’s finding that the claims of DivX’s U.S. Patent No. 10,326,987 were unpatentable. The patent covered a method for adaptive bitrate streaming, a technology for optimizing streaming video quality. The court agreed with the PTAB’s conclusion that the claimed invention was an obvious combination of existing technologies.
