Haynes Boone Team Secures Denial of Summary Judgment in Bitcoin ETF Dispute; Case Heads to Trial

Haynes Boone secured a significant litigation victory for SolidX Management LLC after a New York Commercial Division judge denied VanEck Securities Corporation’s motion for summary judgment in full, allowing the case to proceed to trial on all claims.

The dispute stems from a former partnership between SolidX and VanEck to develop one of the first proposed bitcoin exchange-traded funds (ETF). As part of that effort, the parties entered into agreements governing the launch of a bitcoin trust structure and related investment products, including a Rule 144A offering designed for institutional investors that raises complex contractual issues at the intersection of traditional financial services and digital assets.

Led by Trial Partners Lauren Coppola and Gabriel Berg and with support from Counsel Eric Lindenfeld, Haynes Boone is representing SolidX as plaintiff in claims that VanEck breached the agreements by failing to fulfill key marketing obligations tied to the institutional product and improperly terminating the partnership, despite contractual restrictions linked to the launch of the trust.

In an order issued March 19, 2026, Justice Jennifer G. Schecter of the Supreme Court of the State of New York denied the defendants’ motion for summary judgment, preserving all of the plaintiff’s claims.

The defendants had argued that the case should be dismissed on multiple grounds. The court rejected those arguments at this stage, allowing the claims to proceed to a bench trial following Coppola’s oral argument.

“We presented a strong factual record and clear contractual framework, and the court recognized that these claims should be resolved at trial, not on summary judgment,” Coppola said. “We look forward to proving our case at trial and securing the damages our client is entitled to.”

A status conference is scheduled for April 14, 2026, at which point the court is expected to set a trial date.
