Haynes and Boone, LLP and eight of its lawyers are included in the 2020 edition of Patexia Inc.’s IPR Intelligence Report on the nation’s leaders in inter partes review (IPR) proceedings before the Patent Trial and Appeal Board (PTAB). Among the report’s highlights, Haynes and Boone ranked as the 7th most active firm for petitioners at the PTAB (up from 10th in 2019) and one of the top ten best performing firms overall.
Eight Haynes and Boone lawyers (Jonathan Bowser, Andrew Ehmke, Theo Foster, Eugene Goryunov, Gregory Huh, David McCombs, David O’Brien and David O’Dell) were ranked among the top 100 in various “most active” and “best performing” categories. Overall, the firm was listed among the nation’s top 20 law firms in four separate “best performing firm” and “most active firm” categories.
The 2020 IPR Intelligence Report covers more than 7,700 IPR cases for the last five years (July 1, 2015, through June 30, 2020). Patexia analyzed about 5,000 unique patents and more than 80,000 unique claims challenged over the last five years to come up with the performance scores for all attorneys, law firms and companies on the patent owner and petitioner sides.

Here is the breakdown of the rankings, which include many of the same names from previous rankings:
Top 100 most active attorneys representing petitioners
- McCombs ranked 6th, with 122 petitioner cases. McCombs is primary counsel for many leading corporations in IPR, reexamination, and concurrent patent litigation in the federal courts and before the U.S. Patent Office’s (USPTO’s) Patent Trial and Appeal Board.
- Goryunov ranked 14th, with 93 petitioner cases. Goryunov represents clients in complex patent matters involving diverse technologies and regularly serves as first-chair trial counsel in post-grant review trials on behalf of both Petitioners and Patent Owners at the USPTO.
- Ehmke ranked 35th, with 64 petitioner cases. Ehmke is primary counsel for many high-profile technology companies in IPR proceedings before the PTAB. His practice spans nearly 20 years.
- Foster ranked 44th, with 58 petitioner cases. Foster, a partner who started at the firm 12 years ago, represents both petitioners and patent owners in IPR challenges and other post-grant proceedings before the Office.
- Huh ranked 47th, with 57 petitioner cases. Huh is a partner who actively represents a wide variety of clients in complex and disputed matters.
- Bowser ranked 80th, with 41 petitioner cases. Bowser’s practice focuses on patent litigation disputes before the PTAB and federal district courts.
- O’Dell ranked 91st, with 39 petitioner cases. O’Dell is chair of the Patent Trials and Counseling Practice with more than 20 years of experience as a patent lawyer, including participating in IPR, negotiating patent licenses, and preparing and prosecuting patent applications.
